The agreements we work by

Below you can read what you may expect from us and what we ask of you: how an agreement is formed, what applies to consultations and payment, what happens if you change your mind, and where to turn if something goes wrong.

Article 1 - Definitions and applicability

1. In these terms and conditions, the following definitions apply:

2. These terms and conditions apply to all agreements and quotations.

3. If at any time one or more provisions of these terms and conditions are or become wholly or partly void or are annulled, the remaining provisions of these terms and conditions shall remain in full force. The Parties shall then enter into consultation in order to agree replacement provisions for the void or annulled provisions, observing the purpose and intent of the original provisions as far as possible.

4. First Aid for Your Gut is entitled to engage qualified third parties, and these terms and conditions are stipulated for the benefit of every third party who is engaged in the performance of the Agreement, whether or not under a contract of employment, or who is or may be liable in connection therewith.

5. The applicability of Articles 7:404, 7:407 paragraph 2 and 7:409 of the Dutch Civil Code is expressly excluded.

6. Where these terms and conditions refer to "in writing", this also includes by email.

Article 3 - The offer

1. Every offer is without obligation, unless First Aid for Your Gut states otherwise in its quotation.

2. If a quotation has a limited period of validity or is made subject to conditions, this is expressly stated in the quotation.

3. The offer contains a complete and accurate description of the services offered. The description is sufficiently detailed to enable the Client to make a proper assessment of the offer. If First Aid for Your Gut uses images, these are a true representation of the services offered. Obvious mistakes or obvious errors in the offer do not bind First Aid for Your Gut.

4. Every offer contains such information that it is clear to the Client what rights and obligations are attached to acceptance of the offer. This concerns in particular:

Article 4 - Formation of the Agreement

1. The Agreement is concluded at the moment the Client accepts the Agreement sent by First Aid for Your Gut. Acceptance may take place by electronic signature, by unequivocal electronic confirmation, or by signature on paper. Electronic acceptance has the same effect as a signature on paper.

2. If the Client has accepted the offer by electronic means, First Aid for Your Gut shall confirm receipt of the acceptance of the offer by electronic means without delay. As long as receipt of this acceptance has not been confirmed by First Aid for Your Gut, the Client may dissolve the Agreement free of charge.

3. If the Agreement is concluded electronically, First Aid for Your Gut shall take appropriate technical and organisational measures to secure the electronic transfer of data and shall ensure a secure web environment. If the Client is able to pay electronically, First Aid for Your Gut shall observe appropriate security measures to that end.

4. First Aid for Your Gut is entitled to refuse a request for an agreement without stating reasons.

Article 5 - Performance of the Agreement

1. All agreements are performed by First Aid for Your Gut to the best of its knowledge, judgement and ability.

2. Under the Agreement, First Aid for Your Gut undertakes an obligation to use its best efforts and gives no guarantee as to achieving the intended result, unless a result has been expressly agreed in writing and that result has been described with sufficient definability.

3. First Aid for Your Gut is entitled to engage third parties for the performance of the Agreement and the delivery of services.

4. First Aid for Your Gut is entitled to perform the Agreement in stages and to invoice the part already performed separately.

5. Any delivery periods stated in a quotation, offer or agreement are never strict deadlines. If First Aid for Your Gut exceeds a delivery period, the Client must give First Aid for Your Gut written notice of default, allowing a reasonable period in which to perform the Agreement after all.

Article 6 - Obligations of the Client

1. The Client must provide all data, materials or information that First Aid for Your Gut indicates are necessary, or that the Client should reasonably understand to be necessary for the proper performance of the Agreement, to First Aid for Your Gut in good time and in an accessible form.

2. If the Client does not provide the required or requested data, materials or information, or does not do so in time or correctly, First Aid for Your Gut is entitled to suspend performance of the Agreement. The costs arising from the delay shall be charged to the Client at the usual rates.

3. The Client warrants the accuracy, completeness and reliability of the data, materials or information provided by or on behalf of them to First Aid for Your Gut.

4. The Client also ensures that the data, materials or information provided are free of copyright or other proprietary rights. First Aid for Your Gut is never liable for data, materials or information supplied that are not free of intellectual property rights.

5. If this is necessary for the performance of the Agreement, the Client shall make a proper workplace with the required facilities available free of charge at their location.

6. The Client is not permitted to publish, exploit or reproduce data or parts of the documents, software, advice, reports, presentations, training material and the like that are provided or shown.

7. Making recordings is not permitted, unless the Parties have agreed otherwise in writing.

Article 7 - Price increases

1. If First Aid for Your Gut agrees a particular price with the Client, First Aid for Your Gut is nevertheless entitled, after written notice to the Client, to increase the price if First Aid for Your Gut can demonstrate that significant unforeseen price changes have occurred between the moment the Agreement was concluded and delivery in respect of raw materials, currency, wages or other unforeseen circumstances.

2. If the price increase amounts to more than 15%, the Client has the right to dissolve the Agreement.

Article 8 - (Online) courses and workshops

1. These terms and conditions also apply to all (online) courses and training programmes offered by First Aid for Your Gut.

2. On registration for an online course, an agreement with a payment obligation arises between First Aid for Your Gut and the Course participant.

3. The online course is a supply of digital knowledge. Once the Course participant has been given access to the course, dissolution of the agreement is no longer possible. A Course participant who is also a consumer additionally waives the right of dissolution.

4. For courses and training programmes that take place on a specific day and time, on location or online, and that require the Course participant to be present on that date and at that time, the right of dissolution is excluded. The Course participant may designate a substitute to take their place on that day and at that time.

5. The online course is personal. The content of the course and the login details may never be shared with third parties. First Aid for Your Gut is entitled to block access for a Course participant if it suspects that this has occurred.

6. The Course participant is given access to the online course for 365 days, starting on the day after registration for the online course.

7. First Aid for Your Gut is entitled to change and/or supplement the content of the online courses. Changes give no right to a refund of amounts already paid.

8. First Aid for Your Gut undertakes an obligation to use its best efforts and therefore gives no guarantees as to achieving the intended result. The course is compiled by First Aid for Your Gut to the best of its knowledge and ability. First Aid for Your Gut cannot guarantee that, after completing the (online) course or training, the Course participant will be able to put what they have learned into practice, and cannot give any guarantees regarding results that may be achieved.

Article 9 - Delivery and delivery time

1. The place of delivery is the address that the Client made known to First Aid for Your Gut when the Agreement was concluded.

2. First Aid for Your Gut shall carry out, or arrange for the carrying out of, the dispatch of the order with the greatest possible care.

3. The Client is obliged to take delivery of the purchased Products at the moment they are made available to them under the Agreement. If the Client refuses to take delivery or fails to provide information or instructions necessary for delivery, the Products shall be stored at the Client's risk. In that case the Client shall owe all additional costs, including in any event storage costs.

4. The risk of loss, damage or depreciation passes to the Client at the moment the Products are brought into the Client's control.

5. Delivery periods stated by First Aid for Your Gut are never strict deadlines.

6. If First Aid for Your Gut is unable to meet a delivery period, it shall inform the Client of this in writing.

Article 10 - Changes to the goods to be delivered

First Aid for Your Gut has the right to deliver goods that deviate from what was agreed if this concerns a change to the goods to be delivered, the packaging or the accompanying documentation that is required in order to comply with applicable statutory requirements, or if it concerns minor changes to the goods that constitute an improvement.

Article 11 - Consultations

1. First Aid for Your Gut is entitled to charge for additional work in the case of individual consultations as soon as the consultation lasts longer than the consultation time agreed in advance.

2. The Client may make use of the consultations included in a guidance programme of First Aid for Your Gut for a maximum of one year. After one year, all unused consultations from the guidance programme lapse.

3. No refund is given for unused consultations from the guidance programme if the guidance programme is terminated early by the Client.

4. Unused consultations from the guidance programme are not transferable to third parties.

5. The guidance provided by First Aid for Your Gut is a programme of support and is not limited to or measured by a fixed number of hours. A Client who is a consumer may withdraw from the Agreement within 14 days of its conclusion. First Aid for Your Gut applies this period to all consumers, irrespective of their country of residence. Where guidance has already been provided during that period, that guidance is charged, solely for the purpose of settlement on withdrawal, at a rate of EUR 125 including VAT per hour of consultation time held, rounded to the nearest quarter of an hour. Amounts already paid are refunded within 14 days of the withdrawal, to the extent that they exceed the amount charged. Where payment has not been made, or has not been made in full, the amount charged is invoiced and the payment term set out in Article 13 paragraph 4 applies. The amount charged under this paragraph never exceeds the part of the total price that corresponds proportionally to the guidance provided. The right of withdrawal lapses once the 14-day withdrawal period has expired.

6. If the Client is unable to attend the consultation at the agreed time and date, the Client must notify First Aid for Your Gut no later than 24 hours in advance. Only then can the Parties agree a new date free of charge.

7. The Client may cancel a consultation by contacting their treating therapist by telephone, by email or via WhatsApp.

8. If cancellation takes place within 24 hours before the start of the consultation, the Parties may agree a new date against a new payment. The cancelled consultation shall still be charged.

9. It is not possible to make up missed consultations at a later time, unless there is demonstrable force majeure.

10. If the Client is unable to log in for a consultation on Skype or another medium for a video call for technical reasons, they must inform First Aid for Your Gut of this immediately. First Aid for Your Gut shall then determine whether the consultation can be made up.

11. If the Client logs in late to the medium on which the consultation is scheduled, the original appointment shall not be extended by the delay. The time missed cannot be made up either.

12. All appointment times are stated in the time zone applicable in the Netherlands. Appointments are scheduled in consultation with the therapist, taking account of any difference in time zone between the Client and the therapist. For a consultation scheduled on a Monday, the 24-hour period referred to in paragraph 6 commences at 17.00 on the preceding Friday. The same applies to an appointment on the day following one or more recognised Dutch public holidays: the period then commences at 17.00 on the last preceding ordinary working day.

13. If the Client terminates the Agreement early after it has commenced, there is no right to any refund of the amount paid or still owed by the Client to First Aid for Your Gut. This applies once the period referred to in paragraph 5 has expired.

14. In the case of payment in instalments, the Client is obliged to pay the remaining instalments. If the Client fails to meet their payment obligation, all payment instalments become immediately due and payable from the moment the Client is in default.

Article 12 - Suspension, cessation and dissolution

1. If:

then First Aid for Your Gut has the right to suspend performance under all instructions existing between the Client and First Aid for Your Gut, or to dissolve those instructions in whole or in part without any notice of default and without itself being liable for any compensation, and all obligations of the Client towards First Aid for Your Gut under all instructions existing between the Parties become immediately due and payable. The foregoing does not apply if the Client offers First Aid for Your Gut adequate security for the performance of their obligations.

2. The consequences of suspension, cessation and/or dissolution are entirely for the account and risk of the Client.

3. Suspension, cessation and/or dissolution do not affect the payment obligation for work already carried out. In addition, First Aid for Your Gut is then entitled to claim from the Client compensation for damage, costs and interest caused by the Client's breach of contract and the dissolution of the agreement, including income lost by First Aid for Your Gut.

Article 13 - Price and payment

1. The prices stated in the offer of the services include VAT.

2. The fee of First Aid for Your Gut does not depend on the outcome or the results of the Agreement.

3. First Aid for Your Gut is entitled to perform the Agreement in stages and to invoice the parts thus performed separately, and to require payment (in full) in advance.

4. Payment shall be made no later than 14 days after the invoice date by deposit into or transfer to a bank account designated by First Aid for Your Gut, without any right to discount or set-off.

5. If the Client has not paid within the period referred to in the previous paragraph, they are in default by operation of law, without any further notice of default being required. In the event of the Client's default, First Aid for Your Gut is entitled to charge the statutory interest on the amount not paid or not paid on time, running from the due date until the day of payment in full.

6. If the Client fails to perform one or more obligations towards First Aid for Your Gut, all reasonable costs of obtaining payment, both in and out of court, shall be for the account of the Client, whereby the extrajudicial costs amount to at least 15% of the invoice amount with a minimum of EUR 40.

7. Where there are several clients, each of them is jointly and severally liable for the full invoice amount, insofar as the work was carried out for the benefit of the joint clients and irrespective of the name in which the invoice is made out.

Article 14 - Liability

1. First Aid for Your Gut is liable towards the Client for direct damage resulting from an attributable failure to perform the Agreement. Direct damage means exclusively:

2. Insofar as and as soon as a professional or business liability insurance taken out by First Aid for Your Gut provides cover in the case concerned, liability is limited to the amount paid out under that insurance, increased by the applicable deductible.

3. Where the insurance provides no cover, the insurer does not make a payment, or no insurance was in force at the time of the event causing the damage, liability is limited to the amount charged to the Client under the Agreement.

4. By way of derogation from paragraph 3, liability towards a Client who is not a consumer is, in the case of an Agreement with a term longer than six months, limited to the portion of the fee owed over the last three months.

5. The limitations in this article do not apply where the damage results from intent or wilful recklessness on the part of First Aid for Your Gut.

6. First Aid for Your Gut is not liable for damage of any nature whatsoever arising because First Aid for Your Gut relied on incorrect and/or incomplete data provided by or on behalf of the Client.

7. First Aid for Your Gut is never liable for indirect damage, including: stagnation in the regular course of business of the Client's undertaking, lost profit, missed savings and/or consequential loss.

8. The Client indemnifies First Aid for Your Gut against all claims by third parties for damage occurring in connection with services delivered by First Aid for Your Gut to the Client.

9. First Aid for Your Gut is not liable for shortcomings in the performance of the Agreement by third parties engaged by or on behalf of the Client on the advice of First Aid for Your Gut.

Article 15 - Speaking engagements

1. The Client must arrange the venue themselves, unless the Parties agree otherwise in writing.

2. The Client is responsible for making available, free of charge, all (technical) facilities that First Aid for Your Gut indicates it needs for the presentation.

3. The Parties determine the content of the presentation in consultation. First Aid for Your Gut may deviate from this if it constitutes an addition to the presentation.

4. The Client is entitled to cancel the presentation in writing only, in which case First Aid for Your Gut shall make the costs to be charged to the Client dependent on the period between cancellation and the scheduled presentation:

5. The Client is not permitted to publish, exploit or reproduce data or parts of the documents, software, advice, reports, sheets, presentations, training material and the like that are provided and shown.

6. Making audio and/or video recordings of the presentation is not permitted without the prior consent of First Aid for Your Gut.

7. First Aid for Your Gut provides the Client with material that they may use for promotional purposes.

8. First Aid for Your Gut reserves the right to use the work carried out for the Client for its own promotion.

Article 16 - Indemnification and warranties

1. The Client must at all times consult their doctor before starting to use the Product, if they have any doubt about its use in combination with the Client's health.

2. First Aid for Your Gut expressly gives no guarantees as to the intended result of the Agreement.

3. The Client indemnifies First Aid for Your Gut against any claims by third parties who suffer damage in connection with the performance of the agreement.

Article 17 - Intellectual property

1. All copyright and other intellectual property rights in respect of the content of the services vest in First Aid for Your Gut.

2. The Client is not permitted to reproduce and publish anything from the website, online programme and the like, in any form or manner whatsoever, whether electronically, by photocopying, recordings or in any other way, other than with the written consent of First Aid for Your Gut.

3. The Client is not entitled to sell and/or transfer their rights and/or obligations under the Agreement to any third party, unless agreed otherwise.

Article 18 - Confidentiality

1. The Parties are obliged to keep confidential all confidential information and data they have obtained from each other in the context of the Agreement. These obligations also apply to third parties engaged.

2. Information is deemed confidential unless the other party has expressly stated otherwise in writing or unless this follows from the nature of the information.

3. The duty of confidentiality does not apply insofar as statutory or professional rules impose a duty of disclosure on First Aid for Your Gut.

Article 19 - Retention of title

1. Everything delivered in the context of the Agreement remains the property of First Aid for Your Gut until the Client has duly performed all obligations under the Agreement concluded with First Aid for Your Gut and/or these terms and conditions.

2. Goods delivered by First Aid for Your Gut that fall under the retention of title pursuant to the previous paragraph may not be resold. The Client is not authorised to pledge or otherwise encumber goods subject to the retention of title.

3. The Client must at all times do everything that may reasonably be expected of them to safeguard the property rights of First Aid for Your Gut. If third parties levy attachment on goods delivered subject to retention of title, or wish to establish or enforce rights over them, the Client is obliged to inform First Aid for Your Gut of this immediately.

4. In the event that First Aid for Your Gut wishes to exercise its property rights, the Client gives First Aid for Your Gut unconditional and irrevocable consent in advance to enter all those places where the property of First Aid for Your Gut is located and to repossess it.

Article 20 - Right of withdrawal for Products

1. In the case of Products, the cooling-off period of 14 days commences on the day after the Consumer, or a third party designated in advance by the Consumer who is not the carrier, has received the Products. This possibility of dissolution does not apply to Clients.

2. If the Consumer wishes to withdraw from the Agreement, the Consumer shall notify First Aid for Your Gut of this by means of the model withdrawal form or in writing in another unambiguous manner.

3. During the cooling-off period, the Consumer shall handle the delivered Products and their packaging with care. The Products concerned may not be removed from their original packaging. The Consumer may only handle and inspect the Products as they would be permitted to do in a physical shop.

4. The Consumer must return the products to be returned within 14 days of the day on which the withdrawal was notified, in accordance with the instructions of First Aid for Your Gut, to First Aid for Your Gut or to a third party designated by First Aid for Your Gut. In the event of withdrawal, the shipping or delivery costs are for the account of the Consumer.

5. The risk and the burden of proof for the correct and timely exercise of the right of withdrawal lie with the Consumer.

6. The Consumer has no right of dissolution if the sealed packaging or the seal of the Products has been opened or broken. If the Consumer nevertheless returns Products of which the seal has been opened or broken, the Consumer shall not receive back from First Aid for Your Gut the purchase amount corresponding to the Products concerned.

7. The Consumer is liable only for any depreciation of the Product resulting from handling the Product in a way that goes beyond what is permitted under the previous paragraph.

8. First Aid for Your Gut shall pay the amount to be refunded immediately, but no later than within 14 days following the day on which the Products were received back at the address stated.

9. The Consumer bears the direct costs of returning the Product. If First Aid for Your Gut has not stated that the consumer must bear these costs, or if First Aid for Your Gut states that it will bear the costs itself, the Consumer does not have to bear the costs of return.

10. The Consumer expressly waives the right to dissolve an online course or training programme. The Consumer can therefore no longer dissolve the Agreement once the Consumer has started participating in or downloading the digital content.

Article 21 - Complaints procedure

1. Complaints about the services of First Aid for Your Gut must be reported by the Client to First Aid for Your Gut in writing or by email (hello@firstaidforyourgut.com) within 14 days of the complaint arising.

2. A complaint does not affect any obligations of the Client towards First Aid for Your Gut, nor the rights and obligations arising from them.

3. Complaints about the performance of the Agreement must be submitted to First Aid for Your Gut within a reasonable time, in full and clearly described, after the Client has discovered the defects.

4. Complaints submitted to First Aid for Your Gut are answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, First Aid for Your Gut shall reply within the period of 14 days with an acknowledgement of receipt and an indication of when the Client can expect a more detailed reply.

5. If a complaint is well founded, First Aid for Your Gut shall still perform as agreed, unless this has demonstrably become pointless for the Client. The Client must make the latter known in good time and in writing.

6. First Aid for Your Gut operates a complaints procedure that meets the requirements of the Dutch Care Quality, Complaints and Disputes Act (Wkkgz), including access to an independent complaints officer, through its membership of Zorg doen wij samen B.V., Marathon 2, 1213 PH Hilversum, the Netherlands. If the complaint cannot be resolved by mutual agreement, the Client may submit the dispute to Stichting Zorggeschil, the disputes body recognised by the Dutch Minister of Health, Welfare and Sport to which First Aid for Your Gut is affiliated. Its ruling is binding on both Parties and it may award compensation. Where Stichting Zorggeschil does not accept the dispute, it is submitted to the court referred to in Article 28.

Article 22 - Nature and scope of the services

1. First Aid for Your Gut provides guidance and shares knowledge about how the body works, and about how a person may experience an improvement in or a recovery of their health by adjusting nutrition and lifestyle, by the use of supplements, and by drawing on insights from laboratory testing. The guidance is provided remotely, from the Netherlands.

2. The services are provided by therapists and nutrition specialists who hold Dutch professional qualifications. The practice is conducted by a holder of a Dutch diploma as Orthomolecular Naturopathic Therapist and Epiphysiological Therapist. First Aid for Your Gut is registered in the Netherlands as a provider of complementary care (AGB code 90096987).

3. The services are offered from and performed in the Netherlands. The Client approaches First Aid for Your Gut on their own initiative and receives the services on that basis. The Client is responsible for determining whether they may lawfully receive the services in the country in which they are resident. First Aid for Your Gut is entitled to refuse or discontinue the services where the law of that country prohibits their provision, or where the Client's situation requires in-person medical care.

4. The services are not suitable for acute, urgent or emergency situations. In such a situation the Client must contact their own physician or the emergency services in their own country without delay.

5. The Client remains under the care of their own physician. First Aid for Your Gut never advises the Client to stop or change prescribed medication. Any change to medication is a matter for the Client and their prescribing physician alone.

6. The services do not constitute medical care within the meaning of the licensing regime of the country in which the Client is resident. First Aid for Your Gut does not diagnose disease in the medical sense and does not prescribe medication.

7. No physician-patient relationship arises between the Client and First Aid for Your Gut or any therapist engaged by it.

8. First Aid for Your Gut is not registered, licensed or otherwise authorised as a healthcare provider in any country other than the Netherlands, and makes no representation to that effect.

Article 23 - Laboratory testing

1. Laboratory testing is requested only in consultation with the Client and with the Client's prior consent. By giving that consent, the Client enters into a contractual relationship with the laboratory. Where the Client subsequently withdraws from or terminates the Agreement, any invoices arising from laboratory testing already requested remain for the account of the Client.

2. Where laboratory testing forms part of the guidance, the analysis is carried out by an independent laboratory. That laboratory contracts with the Client on its own terms and conditions. First Aid for Your Gut is not a party to that contract and charges no mark-up on the cost of testing.

3. The laboratory is responsible for the analysis and for the accuracy of the measurements. First Aid for Your Gut is not liable for the analysis itself, nor for any delay, loss or damage occurring in the handling or transport of samples.

4. The interpretation of the results, and the guidance plan based on them, are the work of First Aid for Your Gut and are subject to Article 5 paragraph 2 and Article 14 of these terms and conditions.

5. That interpretation takes place within the professional competence of the therapists engaged and is aimed at guidance on nutrition, lifestyle and supplements. Laboratory results do not constitute a medical diagnosis and are not a substitute for testing ordered by the Client's own physician.

Article 24 - Supplement advice

1. First Aid for Your Gut does not manufacture, stock or sell supplements. Where a supplement is recommended, the Client purchases it directly from a third-party supplier. The purchase contract is concluded between the Client and that supplier.

2. First Aid for Your Gut is not a party to that contract and is not liable for the product, its composition, its availability, or its legal status in the country in which the Client is resident.

3. The Client must consult their own physician before starting any supplement, in particular where the Client uses prescribed medication or is pregnant or breastfeeding.

4. Recommendations regarding supplements have not been evaluated by any medicines or food safety authority and are not intended to diagnose, treat, cure or prevent any disease.

Article 25 - Currency and language of communication

1. All prices are stated in euros. Where the Client pays in another currency, the exchange rate applied and any charges levied by the Client's bank or card issuer are for the account of the Client. The amount received by First Aid for Your Gut must equal the invoice amount.

2. Consultations and correspondence are conducted in English.

Article 26 - Personal data and age

1. First Aid for Your Gut processes personal data in accordance with the General Data Protection Regulation (GDPR) and, in respect of Clients resident in the United Kingdom, the UK GDPR. Data are processed within the European Economic Area.

2. The guidance necessarily involves the processing of health data. Such data are processed only on the basis of the Client's explicit consent, which the Client may withdraw at any time.

3. Where the Client is resident outside the European Economic Area, the Client consents to their personal data being transferred to and processed in the Netherlands.

4. Details of the processing, of the Client's rights, and of retention periods are set out in the privacy policy.

5. The Client must be at least 18 years of age. Guidance for a minor may only be entered into by a parent or legal guardian, who is then the Client under these terms and conditions and is responsible for payment.

Article 27 - Force majeure and continuity of guidance

1. First Aid for Your Gut is not liable for any failure to perform the Agreement where that failure is caused by circumstances beyond its reasonable control, including illness or unavailability of a therapist, failure of communication platforms or internet connections, power failure, government measures, and travel restrictions.

2. In such a case, performance is suspended for the duration of those circumstances. If they continue for longer than two months, either Party may dissolve the Agreement in writing, without either Party owing the other any compensation. Services already performed are charged as agreed and any amount paid for services not yet performed is refunded.

3. Where a therapist becomes unavailable, First Aid for Your Gut arranges a qualified replacement and informs the Client in advance. If a replacement is not available within seven days, the term of the guidance programme, and the period referred to in Article 11 paragraph 2, are each extended by the length of the interruption, so that the Client suffers no disadvantage.

Article 28 - Final provisions

1. These terms and conditions remain in force if First Aid for Your Gut changes its name, legal form or owner.

2. Additional provisions or provisions deviating from these terms and conditions may not be to the detriment of the Client and must be recorded in writing, or in such a way that they can be stored by the Client in an accessible manner on a durable medium.

3. The Agreement is entered into with a party established in the Netherlands. Agreements between the Parties to which these terms and conditions relate are governed exclusively by Dutch law, to the exclusion of its rules of private international law.

4. Any dispute arising from or in connection with the Agreement shall be submitted exclusively to the competent court of the District Court of Overijssel, sitting in Zwolle, the Netherlands. Where the Client is a consumer, this choice of forum applies only to the extent permitted by the mandatory law of the country in which the consumer is resident.

5. These terms and conditions apply to agreements concluded under the trade name First Aid for Your Gut and stand on their own. They enter into force on 14 September 2026.

Annex I. Model withdrawal form

Complete and return this form only if you wish to withdraw from the Agreement. You may also withdraw without using it, as long as your statement is unequivocal.

You have the right to withdraw from the Agreement within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which the Agreement was concluded, or, in the case of Products, 14 days after the day on which you or a third party designated by you, other than the carrier, acquires physical possession of the goods.

Any amount to be refunded is repaid using the same means of payment you used for the original transaction, unless you expressly agree otherwise with us. Providing your bank details is intended to speed up the refund and is not obligatory.
